These Terms & Conditions ("Terms") govern your access to and use of the Workgram mobile application and related services (the "Service"), operated by Alif Miazee Hossain ("Workgram", "we", "us", "our"), based in Tralee, Co. Kerry, Ireland.
By creating an account or using Workgram, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 18 years old to use Workgram.
Workgram is a marketplace platform that connects customers seeking local services ("Customers") with independent workers offering those services ("Workers"). Workgram facilitates the connection, communication, and payment between Customers and Workers.
Workgram is not an employer of Workers. Workers using the platform are independent contractors, not employees, agents, or partners of Workgram. Workgram does not supervise, direct, or control the manner in which Workers perform their services.
Workgram does not perform the services listed on the platform. We provide the technology that connects Customers and Workers; we are not a party to the agreement formed between a Customer and a Worker when a bid is accepted.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Workers may be required to provide additional verification information, including identity documents, trade certifications, insurance details, and a PPS Number (PPSN), in order to access certain features or achieve verified status on the platform.
4.1 Posting Jobs. Customers may post a description of the work they need, including category, location, and budget.
4.2 Bidding. Workers may submit bids on open jobs. A bid is not a binding contract until accepted by the Customer.
4.3 Acceptance and Payment. When a Customer accepts a bid, the Customer must pay the bid amount plus the applicable Workgram service fee through the App's secure payment system, powered by Stripe. Payment is held by Workgram until the job is confirmed complete.
4.4 Job Completion. A job is complete when the Worker marks it as complete and the Customer confirms satisfactory completion. Payment (less the Workgram service fee) is then released to the Worker.
4.5 Disputes. Either party may raise a dispute through the App. Workgram will review disputes in good faith but is not a guarantor of the quality, safety, or legality of services provided by Workers, except as expressly stated in these Terms.
5.1 Service Fee. Workgram charges Customers a service fee on top of the Worker's bid amount: 10% for standard jobs and 15% for emergency jobs, subject to a minimum fee of €2.00. The fee is clearly displayed before payment.
5.2 Payment Processing. All payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service in addition to these Terms.
5.3 Worker Payment. Workers receive their full bid amount. Worker payouts are currently processed via direct bank transfer to the IBAN provided in account settings.
5.4 Taxes. Workers are solely responsible for declaring and paying any tax owed on income earned through Workgram. Workgram is required under EU law (DAC7) to report certain Worker earnings to Irish Revenue where applicable thresholds are met.
Workgram may offer a verification process for Workers, including identity checks, insurance and certification review, and other trust signals. Verification status does not constitute a guarantee by Workgram of a Worker's competence, reliability, or conduct.
Workgram reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent behaviour, or poses a risk to the safety or integrity of the platform.
Reviews must be honest and based on genuine experience. Workgram reserves the right to remove content that is abusive, fraudulent, defamatory, or otherwise violates these Terms.
By posting content on Workgram, you grant Workgram a non-exclusive, royalty-free licence to display that content within the Service.
To the maximum extent permitted by Irish law, Workgram provides the platform on an "as is" and "as available" basis and does not guarantee uninterrupted, error-free, or completely secure operation.
Workgram is not liable for the acts, omissions, quality of work, or conduct of any Customer or Worker. Any agreement for the performance of services is between the Customer and the Worker directly.
To the extent permitted by law, Workgram's total liability to you shall not exceed the total fees paid by you to Workgram in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Irish law.
You agree to indemnify and hold Workgram harmless from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of the Service.
You may delete your account at any time through the App. Workgram may suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful conduct.
We may update these Terms from time to time and will notify you of material changes through the App.
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
